1. Introduction
These Terms of Service (“Terms”) govern your use of the Kitchen Tonic website at kitchentonic.com and any services provided by Kitchen Tonic (“we”, “us”, “our”), a company registered in England and Wales.
By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.
2. Our Services
Kitchen Tonic provides food safety consultancy services to UK hospitality businesses, including but not limited to:
- Food safety compliance audits and consulting
- HACCP plan development and documentation
- Food safety training courses (Level 1, 2, and 3)
- Emergency food safety support
- Online risk assessment tools
- EHO inspection preparation
3. Risk Assessment Tool
Our free online risk assessment tool provides a general indication of your food safety risk level based on the information you supply. It is intended as guidance only and does not constitute a formal food safety audit or guarantee of any particular hygiene rating.
The recommendations and risk scores generated are based on typical industry patterns and should not be relied upon as a substitute for professional on-site assessment.
4. Bookings and Payments
When you book a service or purchase a course, you are entering into a contract with Kitchen Tonic. Prices are displayed in pounds sterling (GBP) and are inclusive of VAT where applicable. Training courses may be VAT exempt where they qualify under HMRC rules.
Payments are processed securely through Stripe. We do not store your payment card details on our servers.
5. Cancellation and Refunds
Consulting services:You may cancel a booked consultation with at least 48 hours' notice at no charge. Cancellations with less than 48 hours' notice may be subject to a cancellation fee of up to 50% of the service cost.
Training courses:You may cancel or reschedule a training course booking with at least 7 days' notice. Cancellations with less than 7 days' notice may not be eligible for a refund but can be rescheduled subject to availability.
Emergency services: Emergency callouts are non-refundable once a consultant has been dispatched.
6. Intellectual Property
All content on our website — including text, graphics, logos, images, and software — is the property of Kitchen Tonic or its licensors and is protected by UK copyright and intellectual property laws.
HACCP plans, training materials, and documentation created for clients remain the intellectual property of Kitchen Tonic. Clients are granted a non-exclusive licence to use these materials for their business operations. Materials may not be resold, redistributed, or shared with third parties without our written consent.
7. Limitation of Liability
Our advice, assessments, and documentation are provided to support your food safety compliance but do not guarantee any specific outcome, including a particular food hygiene rating. Hygiene ratings are awarded solely by local authority environmental health officers based on their independent assessment.
To the maximum extent permitted by law, Kitchen Tonic shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by English law.
8. Your Responsibilities
When using our services, you agree to:
- Provide accurate and complete information about your business and food safety practices
- Implement recommendations in a timely manner as advised by your consultant
- Maintain appropriate food safety standards between consultations
- Notify us of any significant changes to your business operations that may affect your compliance status
9. Website Use
You agree not to:
- Use our website for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Transmit any malicious software or harmful code
- Reproduce, duplicate, or resell any part of our website without permission
10. Third-Party Services
Our website may contain links to third-party websites and services. We are not responsible for the content or practices of these external sites. Your use of third-party services is subject to their own terms and conditions.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated “last updated” date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
